Nine European countries already allow Tesla’s FSD (Supervised). Switzerland is not one of them, and Bern has refused nothing: Tesla has not asked. “So far, FEDRO has not received any application from Tesla for such an approval in Switzerland,” the Federal Roads Office writes in answer to Tesla Mag’s questions. No application filed in Bern<\/h2>\n\n\n\n

In its written answer of 23 October 2026, the Federal Roads Office (FEDRO, known in French as OFROU and in German as ASTRA) is clear: Tesla’s FSD “currently has neither a European type approval nor an approval for Switzerland”. And the office has received no application from the carmaker.<\/p>\n\n\n\n

The detail matters. The provisional approval granted in April by the Dutch authority, the RDW, does not automatically apply in other European countries: each EU member state can choose to recognise it, and can ask Tesla for adjustments before allowing the system on its roads. Switzerland does not recognise it automatically either. Only a European type approval, granted at EU level, would apply in every member state, and Switzerland would adopt it under its agreements with the EU. For Switzerland, Tesla therefore has two routes: file an application with FEDRO, which would assess it under Swiss law, or obtain a European type approval. “The choice of when and in which country to have a vehicle or a system approved belongs to the manufacturer,” the office points out.<\/p>\n\n\n\n

Driver assistance, not automated driving<\/h2>\n\n\n\n

FEDRO classifies Tesla’s system, “in its current state”, among Driver Control Assistance Systems (DCAS): assistance systems “capable of taking control of the vehicle”, at level 2+. The direct consequence: “the driver remains responsible for driving” and, for the office, “hands must remain on the steering wheel at all times”.<\/p>\n\n\n\n

The line is drawn at level 3, that of automated systems. “Only from level 3 systems onwards can the driver take their hands off the wheel, and does liability fall on the vehicle manufacturer in the event of an accident with the system engaged,” the office says.
